One of the great parts of representing taxpayers with IRS appeal problems is that the law gives them plenty of rights. One of my favorite is the appeal.
- If a Revenue Officer does not accept my proposal for an Installment Agreement, I appeal.
- Should a Revenue Agent does not accept my numbers on an audit, I appeal.
- If an Offer Specialist does not accept my Offer in Compromise, I appeal.
- If the IRS levies my client’s wages or bank account, I appeal.
The IRS does not always tell taxpayers about their right to appeal adverse decisions. There are forms and timing issues that make it far more complicated than it should be for someone without a representative.
The IRS Appeals Mission is to resolve tax controversies, without litigation, on a basis which is fair and impartial to both the Government and the taxpayer and in a manner that will enhance voluntary compliance and public confidence in the integrity and efficiency of the Service.

Given the above job description, I always want to deal with the Appeals Office. I find I get my best settlements with them – and that, of course, is the goal in every case.
